The Florida Department of Financial Services, Division of Insurance Agent and Agency Services states that you must be licensed and appointed with a license that includes health to offer ObamaCare products. These license types include: 2-15 (Life, Health, & Annuity Contracts) and 2-40 (Health Agents). The ability to sell ObamaCare is not included in the 2-20 (General Lines Agent) or 4-40 (Customer Service Representative) authorities.
At this time, there are two exceptions to this rule is as follows:
- If a 2-20 agent held a health appointment PRIOR to 2005, and has since maintained that appointment and kept current with their continuing education, they are “grandfathered” in and are eligible to sell health products.
- A 2-20 General Lines Agent may sell health insurance as long as it is included in the agent’s appointment by the insurance company as to which the licensee is also appointed as an agent for property or casualty or surety insurance.
A licensee is appointed with XYZ Property & Casualty Insurance Company as a 2-20 agent. The agent may only sell the health products sold by XYZ Property & Casualty Insurance Company. The licensee would not be able to sell health products that are sold independently through a different health insurance carrier.
